In 2014 the non-governmental organization The Italian Committee for Global Water Contract entrusted the Department of Law of the University of Milano-Bicocca with the academic exercise of of preparing a tentative draft treaty on the human right to water and sanitation. The task was accomplished, on behalf of the Department, by Gabriella Citroni and Tullio Scovazzi. The draft was circulated to a number of governments and received by them different reactions, ranging from constructive comments to negative attitude and indifference. It is reproduced hereunder in the English text (versions in French and Spanish are also available).

La actual Constitución Política de Colombia, vigente desde 1991, contiene numerosas disposiciones en torno al medio ambiente y establece una responsabilidad compartida entre el Estado y los particulares como sujetos garantes de su protección. En cumplimiento de este mandato constitucional el Estado ha designado a las autoridades ambientales, como funciones cardinales, procurar por la gestión de los recursos naturales renovables, imponer sanciones en los casos de violación de las normas de protección ambiental y exigir la reparación de los daños ambientales generados. Así también la Constitución otorgó a los particulares la facultad-deber de participar bajo distintos mecanismos jurídicos, en las decisiones que los afecten, especialmente, en aquellas que puedan poner en riesgo el derecho al goce de un ambiente sano.

The essay purposes to address a link between climate change and water availability as well as associate the effects of climate change with the water crisis that has affected two regions in a similar way: California and Sao Paulo. In this scenario, as one important water source supply, this paper will focus on groundwater. It will indicate the legislation related to groundwater usage and management in both states, California and Sao Paulo. It analyzes if the legislation in both places establishes a link with climate change, that is, if groundwater regulation is based on climate change in order to mitigate its effects.
